DMCA Policy for Chicken Stock

At Chicken Stock, we respect the intellectual property rights of others and expect our users to do the same. This DMCA (Digital Millennium Copyright Act) Policy outlines the procedures for reporting alleged copyright infringement and for submitting counter-notifications regarding content hosted on our platform.

It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). We will promptly process and investigate notices of alleged infringement and will take appropriate actions under the DMCA and other applicable intellectual property laws.

Filing a DMCA Notice of Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Chicken Stock platform, please send a written DMCA notice to our Designated Copyright Agent with the following information:

  1. Identification of the copyrighted work: Provide a description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: Provide a description of the material that you claim is infringing and where it is located on the Chicken Stock platform (e.g., a specific URL or clear description sufficient to locate the material).
  3. Contact information: Your name, physical address, telephone number, and email address.
  4. Good faith belief statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA notice, we will investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.

Filing a DMCA Counter-Notification

If you believe that material you posted on the Chicken Stock platform was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. Your counter-notification must include the following:

  • Identification of the material removed: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Contact information: Your name, physical address, telephone number, and email address.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Chicken Stock may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Electronic or physical signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at our sole discretion.
